1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Phluit ("Company", "we", "us", or "our"), concerning your access to and use of the phluit.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.
PLEASE READ THESE TERMS CAREFULLY. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms of Service, and you waive any right to receive specific notice of each such change.
2. Eligibility
The Services are intended solely for persons who are 18 or older. Any access to or use of the Services by anyone under 18 is expressly prohibited. By accessing or using the Services, you represent and warrant that you are 18 or older.

3. Services Description
Phluit provides managed WordPress hosting services, including but not limited to:
- Managed WordPress hosting on high-performance infrastructure
- Automated daily backups and one-click restore
- WordPress core, theme, and plugin updates
- SSL certificate provisioning and renewal
- Security monitoring, malware scanning, and removal
- Performance optimization including caching and CDN
- 24/7 technical support via email and ticket system
- Staging environments for safe testing
Service Uptime: We strive to maintain 99.9% uptime. Scheduled maintenance will be communicated in advance. See our
Service Level Agreement for details.
4. Billing and Payment
By selecting a paid subscription, you agree to pay Phluit the monthly or annual subscription fees indicated for that service. Payments will be charged on a recurring basis unless and until you cancel your subscription or we terminate it.

Refund Policy: We offer a 30-day money-back guarantee on new hosting accounts. Refunds are not available for domain registrations, SSL certificates, or accounts suspended for Terms of Service violations.
5. Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make the Services available. The following activities are strictly prohibited:
- Systematically retrieving data from the Services to create a database or directory without written permission
- Hosting, distributing, or transmitting malware, viruses, or any code of a destructive nature
- Sending unsolicited commercial email (spam) or bulk email campaigns without opt-in consent
- Engaging in unauthorized framing or linking to the Services
- Attempting to impersonate another user or person
- Using the Services for any illegal or unauthorized purpose
- Hosting content that infringes on intellectual property rights
- Running scripts or processes that negatively impact server performance for other users
- Storing or transmitting content that is unlawful, harmful, threatening, abusive, or obscene
- Attempting to gain unauthorized access to other user accounts or server resources

6. Intellectual Property
Unless otherwise indicated, the Services are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
Your Content: You retain ownership of all content you upload to our servers. By using our Services, you grant Phluit a limited license to host, cache, and serve your content solely for the purpose of providing the Services to you.
7. Backups and Data
While Phluit performs daily automated backups as part of our managed hosting service, you are ultimately responsible for maintaining your own independent backups of all your data.

Disclaimer: Phluit is not liable for data loss due to hardware failure, software bugs, user error, or events beyond our reasonable control. We strongly recommend maintaining your own off-site backups.
8. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Use a strong, unique password for your account
- Enable two-factor authentication where available
- Immediately notify us of any unauthorized use of your account
- Not share your login credentials with any third party
- Log out of your account at the end of each session on shared devices
Security Incident: If you suspect unauthorized access to your account, contact
support@phluit.com immediately. We will work with you to secure your account.
9. Termination
These Terms of Service remain in full force and effect while you use the Services. We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Immediate suspension for Terms violations, with notice where practical
Data After Termination
Your data is retained for 30 days post-cancellation, then deleted
Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may do so by contacting us at support@phluit.com.
10. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Phluit, its affiliates, directors, employees, agents, suppliers, or licensors be liable to any person for any indirect, incidental, special, punitive, cover, or consequential damages arising out of or connected with these Terms or your use of the Services.
Liability Cap: Our total cumulative liability to you arising out of or related to these Terms will not exceed the greater of: (a) the total fees you have paid to Phluit in the 12 months prior to the event giving rise to liability, or (b) $100 USD.
11. Governing Law
These Terms shall be governed by and defined following the laws of the jurisdiction in which Phluit operates. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

contact us to resolve disputes informally. We are committed to addressing your concerns fairly and promptly.
12. Changes to Terms
We reserve the right to modify these Terms of Service at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Continued use of the Services after any such changes shall constitute your consent to the revised Terms.
For material changes, we will make reasonable efforts to notify you via email to the address associated with your account or via a prominent notice on our website at least 30 days before the changes take effect.
