Phluit Affiliate Terms of Use
1. Introduction
These Affiliate Terms of Use (the “Terms”) govern the relationship between Phluit (“Phluit”) and its affiliates (“Affiliates”).
2. Eligibility
To become an Affiliate, you must be an individual or entity that can enter into legally binding contracts and meet the following criteria:
- You have a valid and active website or social media account.
- You have a consistent following or readership.
- You are willing to promote Phluit’s products and services in a genuine and authentic manner.
3. Program Overview
Phluit offers an affiliate program that allows Affiliates to earn commissions by promoting Phluit’s products and services to their audience. Affiliates can earn commissions on sales generated through their unique referral links.
4. Participation
To participate in the Affiliate Program, you must register for an account on Phluit’s affiliate portal. Once registered, you will receive a unique referral link. You can use this link to promote Phluit’s products and services on your website, social media accounts, or other online channels.
5. Tracking and Commissions
Phluit will track all traffic and sales generated through Affiliate referral links. Affiliates will earn commissions on each sale generated from their referral links, as defined by the current commission structure. Commissions will be paid to Affiliates on a monthly basis.
6. Performance
Phluit may review Affiliate performance periodically and may make adjustments to commission rates or terminate Affiliates who do not meet performance expectations.
7. Content and Compliance
Affiliates must promote Phluit’s products and services in a truthful, honest, and accurate manner. Affiliates must not make false or misleading claims about Phluit’s products or services. Affiliates must comply with all applicable laws and regulations.
8. Links and Attribution
Affiliates must use Phluit’s approved referral links when promoting Phluit’s products and services. Affiliates must attribute all sales to Phluit and not claim credit for sales that are generated through Phluit’s own marketing efforts.
9. Confidentiality
Affiliates must not disclose any confidential or proprietary information of Phluit to any third party.
10. Termination
Phluit may terminate an Affiliate’s participation in the Affiliate Program for any reason, including but not limited to violation of these Terms, performance issues, or changes to Phluit’s business model.
11. Indemnification
Affiliates agree to indemnify and hold harmless Phluit, its affiliates, and their respective directors, officers, employees, and agents from and against any and all losses, damages, liabilities, claims, or expenses (including reasonable attorneys’ fees) arising out of or in connection with Affiliate’s participation in the Affiliate Program.
12. Entire Agreement
These Terms constitute the entire agreement between Phluit and Affiliates with respect to the Affiliate Program and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
13. Amendment
Phluit may amend these Terms from time to time by posting the amended Terms on its affiliate portal. Affiliates will be deemed to have accepted the amended Terms by continuing to participate in the Affiliate Program after the amended Terms have been posted.
14. Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of California.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck from these Terms and the remaining provisions will remain in full force and effect.
16. Waiver
No waiver of any provision of these Terms will be effective unless in writing and signed by both parties.
17. Counterparts
These Terms may be executed in one or more counterparts, each of which will be deemed an original, but all of which together will constitute one and the same instrument.
